Terms of Use

These terms cover GoreBoy and any other mobile app published by Thin Air Studio, a Brabson Ventures LLC company ("we," "us"). By installing or using an app, you agree to them. If you don't agree, don't use the app.

The short version: the game is free, the purchases are optional and go through the app stores, the only things we hold about you are a random ID if you play ENDLESS and a leaderboard entry if you choose to post one, and we're not liable if the app doesn't work for you. The longer version follows.

1. License to use the app

We give you a personal, non-exclusive, non-transferable, revocable license to install and play the app on devices you own or control, for your own non-commercial use, under these terms and the rules of the app store you got it from. The app is licensed to you, not sold.

2. Purchases and tips

The app is free to play in full. It offers two kinds of optional in-app purchases, both processed by Apple or Google rather than by us:

• Ad-free. A one-time purchase that removes advertisements from the app. It changes nothing else about the game. It is tied to your app store account and can be restored on any device signed in to that account.
• Tips. Small one-time payments that support the developer. A tip unlocks nothing and is not required for any part of the game. Tips are consumed when purchased and cannot be restored.

Prices are shown in the app in your local currency before you confirm. Payment, receipts, and refunds are handled by Apple or Google under their policies; we don't see your payment details and can't issue refunds directly. If a purchase didn't go through or the ad-free unlock isn't showing, use the restore option in the app's settings first, then contact us at support@goreboy.com.

We may change prices or discontinue a product at any time. That won't affect a purchase you already made.

3. Ads

Unless you've bought ad-free, the app shows rewarded video ads served by Google AdMob. Rewarded ads are only ever offered, never forced: you choose whether to watch one in exchange for something in the game, such as a continue or a powerup. Ad content is provided by third parties, and we don't endorse what's advertised. Where the law requires it, the app asks for your consent before showing personalized ads. 4. Age

The app is rated for ages 13 and up and contains stylized cartoon violence and gore. It is not directed at children under 13. If you're under the age of majority where you live, you may only use the app with a parent or guardian's permission, and they're responsible for any purchases.

5. What you can't do

Don't:

• copy, modify, decompile, reverse-engineer, or create derivative works of the app, except where the law says we can't stop you;
• redistribute the app or any part of it, or sell access to it;
• tamper with the app's purchase or advertising systems, or use the app to generate fraudulent ad traffic;
• use the app's name, art, characters, or audio in a way that suggests we endorse something we don't, or that violates someone else's rights;
• submit leaderboard scores you didn't earn. We may remove entries or block an account from the leaderboard for it, without notice.

Beyond that, it's a single-player game. Play it however you like.

6. Our content

The app, including its code, art, characters, writing, music, and sound, is owned by Brabson Ventures LLC or licensed to us, and is protected by copyright and other intellectual property laws. GoreBoy and the Thin Air Studio name and logo are our trademarks. You may capture and share gameplay footage and screenshots, including for monetized videos and streams. We'd love to see them.

7. Updates and availability

We may update, change, or stop offering the app or any feature at any time. Updates may be required to keep playing. We don't guarantee the app will be available in every country or on every device, or that it will run well on devices below its stated minimum requirements. Game progress is stored on your device; we don't keep a copy and can't recover it if the app is uninstalled or the device is lost. Leaderboard entries live on our servers and are public; see the Privacy Policy for what they contain and how to remove one.

8. No warranty

The app is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise it will be uninterrupted, error-free, or free of bugs. Some jurisdictions don't allow these exclusions, so some of them may not apply to you.

9. Limitation of liability

To the fullest extent permitted by law, Brabson Ventures LLC and its owners won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or lost progress, arising from your use of or inability to use the app. Our total liability for any claim relating to the app is limited to the amount you paid us for it in the twelve months before the claim, or ten US dollars, whichever is greater. Nothing in these terms limits liability that can't be limited by law.

10. App store terms

If you got the app from the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies, and where it conflicts with these terms, Apple's terms govern for your relationship with Apple. Apple isn't a party to these terms and has no obligation to provide support for the app. If you got the app from Google Play, Google's terms of service for Google Play also apply. Apple and Google are third-party beneficiaries of these terms and may enforce them against you.

11. Governing law

These terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Colorado, and you consent to their jurisdiction. If you live somewhere whose consumer laws give you more protection, those still apply.

12. Changes to these terms

We may update these terms from time to time. When we do, we'll post the new version here and update the date at the top. Continuing to use the app after a change means you accept the new terms. If you don't, stop using the app.
